There was a loss in 2021
Victim Olsen had anaphylaxis after eating a burger in February 2021. In his complaint, the 28-year-old man stated he had purchased a burger meal from food service DoorDash, in which he had specified that there be no American cheese. Along with this information, he sent a screenshot of his complaint.
Allergy occurred immediately after eating
The burger was obtained at the McDonald’s at 335 Eighth Avenue. The complaint claims that he became uncomfortable and itching within minutes of consuming the burger. In addition, he suffered throat swelling and rashes all over his body. He then called his girlfriend, who was living with him.
When he viewed the burger, he noticed that it featured American cheese, which the complaint had refused. Olsen quickly developed hives across his body and became unable to breathe. His girlfriend quickly brought him to the hospital, where he was treated for anaphylaxis. According to the lawsuit, the man required intubation to survive, and physicians took hours to treat him.
There is no option while ordering
According to local news agency, Olsen said through his lawyers, “Allergies sound like a simple thing, but there should be options to deal with them. There is no option given when ordering, explaining What is the allergy and what is the allergy? Also, the employees are not properly trained to handle it.”
McDonald’s responded
In a statement, the McDonald’s franchise owner stated, “Nothing is more essential than our customers’ safety. We take each complaint seriously and are currently investigating these allegations. Olson filed a lawsuit against McDonald’s.” He is accused of failing to fulfill his duties to “produce safe food.” He seeks monetary damages and a jury trial.
