In a landmark decision, Fulton County Superior Court Judge Robert McBurney declared that “no election superintendent (or member of a board of elections and registration) may refuse to refuse to certify or abstain from certifying election results under any circumstance.”He emphasized that while election officials have the right to investigate concerns about vote integrity, these concerns do not provide a valid reason to delay or refuse certification.

The ruling clarified that any doubts regarding potential fraud or errors must be communicated to the appropriate authorities, but they cannot serve as a basis for not certifying election results. Any delay in receiving such information is not a basis for refusing to certify the election results McBurney stated.
